Hazardous waste

Hazardous waste presents significant risks to human health and the environment due to its chemical, physical, or biological properties. These wastes can be flammable, corrosive, reactive, or toxic. Examples of hazardous waste include industrial chemicals, batteries, solvents, and medical waste.

Types of hazardous waste

  1. Chemical waste: Includes industrial chemicals, expired or used chemical products, and waste from chemical manufacturing processes. Examples:

Non-hazardous waste

Non-hazardous waste poses no significant risks to human health or the environment. However, proper management is still crucial to reducing pollution and promoting recycling. Examples of non-hazardous waste include household waste, paper, plastics, glass, and food waste.

Legislation and regulations for waste transport

Waste transport is regulated by HG No. 1061/2008, which establishes the legal framework for the transportation of hazardous and non-hazardous waste within Romania.

Regulations for hazardous waste quantities

Depending on the quantity of hazardous waste generated, the following procedures apply:

  • Less than 1 ton per year: Transport is based on the hazardous waste loading-unloading form (Annex 2).
  • More than 1 ton per year: Transport requires both the hazardous waste transport approval form (Annex 1) and the loading-unloading form (Annex 2).

Obtaining approval for hazardous waste transport

To obtain approval for the transport of hazardous waste, the waste generator or holder must complete a transport authorization form in six copies.

Responsibilities of the County Environmental Protection Agency

The County Environmental Protection Agency is responsible for:

  • Signing and stamping the waste transport approval form after verifying the provided information.
  • Requesting additional information from the sender, recipient, or National Environmental Guard.
  • Verifying compliance with protected natural areas and Natura 2000 sites.

Transport notification

According to Article 14 of HG 1061/2008, the sender must notify the county emergency inspectorate 48 hours before the approved transport is carried out.

Procedures in the event of an accident

In the event of an accident during transport, the transporter must immediately notify the ISU (Emergency Situations Inspectorate) and the APM (Environmental Protection Agency) of the county where the incident occurred.

Responsibilities of waste producers and holders

Waste producers and holders are required to ensure that during collection, transportation, and storage operations, hazardous waste is packaged and labeled in accordance with Regulation (EC) No. 1272/2008 of the European Parliament and of the Council. This regulation sets rules for the classification, labeling, and packaging of substances and mixtures, amending and repealing Directives 67/548/EEC and 1999/45/EC, and amending Regulation (EC) No. 1907/2006.
